Who Is The Organiser?

Indian Institute of Arbitration & Mediation (IIAM) is one of the pioneer institutions in India, providing institutional Alternative Dispute Resolution (ADR) services, which includes international and domestic commercial arbitration, mediation and negotiation and conducting training programs in ADR. IIAM is a non-profit organization registered in India and commenced activities in the year 2001.IIAM is one of the founding members of Asia Pacific Centre for Arbitration & Mediation (APCAM) and functions as the APCAM Centre in India. IIAM is also the first Secretariat of APCAM, having centres in most of countries in the Asia Pacific Region.The legal and ethical aspects are guided and controlled by the IIAM Advisory Board, comprising of distinguished and eminent persons from various fields, chaired by Mr. Justice M.N. Venkatachaliah, former Chief Justice of India. The IIAM Community Mediation Service is guided by the CMS Committee, chaired by Mr. Justice K.T. Thomas, former Judge, Supreme Court of India. Administration of IIAM is by the Governing Council.

IIAM is recognised by the Department of Justice, Ministry of Law and Justice, Government of India.  IIAM was the first institution in India approved by the International Mediation Institute (IMI) for qualifying mediators for IMI certification. IIAM is a member of the Asian Mediation Association (AMA) and the Asia Pacific Regional Arbitration Group (APRAG). IIAM is the country representative – India for Mediation World, UK.

APCAM (Asia Pacific Centre for Arbitration & Mediation) is an International ADR Center formed jointly by Centers from many countries in the Asia Pacific Region, which host APCAM centers in their respective countries. APCAM caters the requirement of international and cross-border business disputes, and help the business community to resolve their international commercial and business disputes by mediation or arbitration under a single set of Mediation and Arbitration Rules and with a uniform fee structure in all the member countries to minimize the hassle of adhering to different laws or fees of different institutions. APCAM also empanels a common panel of international mediators and arbitrators, with uniform accreditation system from all the countries, which would help the parties to experience uniform high-standard practice, bringing credibility and professionalism of mediators and arbitrators.

The Professional Certificate in Commercial Arbitration is an APCAM Certified Training Program. It provides knowledge and an appreciation of commercial arbitration and its role within the Indian legal system. It offers the participants the theory of arbitration law and practice, with emphasis on procedure of arbitration, both ad-hoc and institutional, drafting of arbitration agreements, framing of issues and making of arbitral awards. The program will also look at the art of making dispute resolution clauses appropriate to the parties’ business needs and dispute resolution desires. The program provides a solid foundation for participants to become an Arbitrator and expertise to represent in Commercial Arbitration as an Arbitration Lawyer / Consultant. .

What Are The Details Of The Course?

  • Title of the course: Commercial Arbitration
  • Duration: The Professional Certificate in Commercial Arbitration Program at IIAM, is conducted for 3 days (24 hours). But due to the COVID-19 pandemic and travel restrictions, the program is now conducted online extending 4 days.
  • Eligibility: Lawyers, Chartered Accountants, Company Secretaries, Engineers, and all professionals or persons who have undergone graduate-level education are eligible for enrolment in this program.

  • Benefits: On successful completion, the participant will be qualified as “IIAM Panel Arbitrator” and in accordance with IIAM Accreditation system as per IIAM QAP-5, will be eligible to be accredited as “IIAM Certified Arbitrator” and can be empanelled with IIAM and Peacegate. The accreditation fee under QAP-5 is complementary for participants of PCCA, submitted as part of program. Being an APCAM Certified Training Program, completion of the program successfully will also enable the participant to apply for accreditation under the APCAM (Asia Pacific Centre for Arbitration & Mediation) Accreditation norms , which would empanel the participant as an arbitrator in the roster of all the APCAM centres.
  • Evaluation & Certification: The participant will undergo certain roleplays and will be given certain assignments during the course of the program. They are designed to help the participant to understand the practical aspects of arbitration and to write effective arbitral awards (both domestic and international). The participant’s attendance and interaction during the program and roleplays will be assessed, along with the assignments. On successfully completing the program, the participant will be awarded the certificate, along with the course transcript.
